Trial postponed for Logan man accused of rape

LOGAN — The October jury trial for a 39-year-old Logan man facing 17 charges, including rape of a child and object rape, has been postponed.

Cody C. Smith was in 1st District Court Tuesday morning for a pretrial conference.

Smith’s attorney asked Judge Brian Cannell to reschedule the trial, saying there was a scheduling conflict.

Smith is accused of encouraging a teenage girl and her boyfriend to engage in sex, while in his home. The girl has also testified previously that Smith fondled her multiple times.

Smith was arrested March 11 by officers with the Utah State University Police Department. They are investigating the case because Smith had worked for both the Logan City Police Department and the Cache County Sheriff’s Office.

A previous five-day trial was postponed in June after Smith fired his public defender and hired a new defense lawyer.

During Tuesday’s hearing, Judge Cannell rescheduled the five-day jury trial to now begin January 26.

Smith was released from the Cache County Jail in May after posting an $80,000 bail.
