Logan Landlord license applications increase

By Associated Press

LOGAN, Utah (AP) -- Landlords in Logan were a little slow to catch on to a new law that requires licenses to rent out property.

In the month since the law took effect on July 1, the number of applicants increased from about 100 to more than 900. But with 2,200 estimated landlords in the city, less than half have applied for the new licenses.

City licensing manager James Olson says property owners who have created rental units in houses without city permission and those who are allowing too many people to share units are likely among the holdouts.

Identifying overcrowded houses is among the city's reasons for the new law.

Olson says the city will ask unlicensed landlords to get licensed or be fined.

Read the fair housing act. any policy or law issued by a state that discriminates against a group shall be superceded by federal law. In this case, students, unmarried familys, underprivledged/poor, are all discriminated against. Further, the utah state legislature in its last session adressed this and specifically limits the citys power to limit the number of unrelated persons sharing a home.

So, most of the new logan landlord laws cannot be held up if you get as far as a courtroom.

Federal law states that citys cannnot limit the number of people living in a home related or not. This was recently reiterated by the utah state legislature. Utah state legislature also passed a law stating that a city cannot by requirement of business license close a non conforming use. Provo is having meetings about these laws right now.

"Olson says the city will ask unlicensed landlords to get licensed or be fined." I'm still waiting for the city to actually ask me to get licensed in the first place. They have yet to ever contact me and officially inform me that this is a new law. A stupid law, but I digress. Just as soon as they ever send me the very first notice, I will CONSIDER getting licensed. Until then, I'll keep ignoring it. Since when is the Herald Journal the official notification arm of the government????

Question... said on Sunday, Aug 8 at 11:06 AM

Can someone define "landlord"? I make my kid pay rent, while he is living at home and choosing not to go to school. My inlaws also live with us - mostly so we can help them with thier health issues, but they pay us, to help offset the cost of our mortgage? Does that make me a landlord? where are they coming up with this 2200 #? Because I have no intention of getting licensed.

a Few points of clarification.... 1) a "little slow" = protest 2) who gets to say how many people can live in a house? Really? my grandmother lived in a house where the boys slept in the living room, the girls in the attic, and the parents in the one bedroom. Unless it was summer, and then the boys slept outside in the barn. It has always bothered me, that since I was a single mother, I had to rent a 2 bedroom place, becuase I have children. I wasn't "allowed" to rent what I could afford for my children. Being widowed really screwed me over. And lets me realistic? Identifying overcrowded houses? Is the city of Logan going to start going into homeowners and telling them , you have to many kids - you have to move? I think that is MUCH to far over the line.
