Child abuse trial postponed as attorneys get new evidence in the case

LOGAN — The child abuse trial for a 32-year-old Logan father, Ryan Udy, was postponed Tuesday morning just as the 100 potential jurors were getting comfortable in the courtroom.

Judge Brandon Maynard agreed to continue the two-week trial and excused the jury after defense attorneys told the court they had received new evidence in the case.

The felony charges against Udy stem from two incidents where police report he abused his infant son, breaking his arm, and causing bruises and other injuries. The abuse was reported in December 2012 and March 2013.

Defense attorneys argue Udy was only left with the child for a short time and that the abuse was caused by the child’s mother.

Later, defender Wayne Caldwell said he asked for the trial to be postponed after prosecutors disclosed on Monday, a DCFS witness who claimed to have received two anonymous emails describing how the mother abused the child. He said even though the emails are from an unidentified sender, they wanted to follow up on them.

Prosecutors didn’t feel like the additional evidence changed the facts of the case. State attorney Spencer Walsh said they were prepared to go to trial Tuesday morning. He said, he was hopeful that both parties could prioritize their efforts and try the case in front of a jury soon.

Judge Maynard ordered Udy to appear again in court September 21 for a pre-trial conference.
