Defense attorney filing motion for Smithfield man accused of sexually abusing child

LOGAN — A 43-year-old Smithfield man accused of physically and sexually abusing a child will remain in jail on $125,000 bail.

Andrew Facer appeared in 1st District Court Monday afternoon for a pretrial conference. He was previously charged with one count of aggravated sexual abuse of a child, a first-degree felony, and five misdemeanors including two counts of voyeurism, along with assault, domestic violence and child abuse neglect.

After talking with attorneys for both sides, Judge Kevin Allen said public defender Mike McGinnis was planning to file a motion that the court will consider. The type of motion was not discussed.

State attorney Jacob Gordon said he was unable to comment on the motion until it is submitted.

Police allege that the abuse occurred in recent years and involved a victim who knew Facer. Detectives questioned the defendant while investigating a Richmond man, <a href=”http://www.cachevalleydaily.com/news/local/article_63b467a0-b5c4-11e6-9e66-5b5ef9b02e5d.html” target=”_blank”>Dustin Mangum</a>, who was arrested in August on similar allegations.

Facer and Mangum reportedly know each other through marriage.

During Monday’s court appearance, Judge Allen ordered Facer to appear again in court March 13.
