The preliminary hearing for a 41-year-old Preston, Idaho man charged with murder has been postponed for a second time.

James Kelly Pilgrim was supposed to appear in 6th Judicial District Court in Franklin, Friday afternoon. Court records show, earlier in the week, the hearing was rescheduled for July.

In May Judge Eric S. Hunn ordered an evaluation of Pilgrim to determine if he was mentally competent to stand trial. He is being held in the Caribou County Jail.

Pilgrim was arrested Saturday April 26, accused of shooting 43-year-old Chad Kirk Andrus. The two had been drinking and got into an argument in an out-building at Andrus' residence, 801 West 800 North..

Preston City Police Chief Ken Geddes said Andrus was reportedly shot multiple times and was pronounced dead at the scene. Pilgrim was also injured and taken to Franklin County Medical Center. Later that morning, he was booked into the Franklin County Jail.

Pilgrim is being charged with second-degree murder, aggravated assault with a firearm and unlawful possession of a firearm by a felon. He is now expected in court July 18.
