CORRECTION: On August 5 CacheValleyDaily ran a story about a Preston man charged with vehicular manslaughter. It was reported a jury found John Kautz, 40, guilty of vehicular manslaughter when in fact Kautz entered a plea deal and subsequently waived his right to a jury trial. He was sentenced three to five years in prison and fined the maximum $1,000, court costs, victim’s compensations, and funeral expenses for the victim. On October 23, 2009 Kautz was involved in an incident that killed 13- year-old Andy Zapoloski. The two were driving motorized go-carts near 180 N. 300 E. in Preston when Zapoloski slowed down. Kautz, whose blood alcohol level was .159 at the time, ran into the teen’s go-cart going between 19-25 mph, overturning it. Neither were wearing seatbelts at the time. Zapoloski was life-flighted to Primary Children’s Hospital with severe head trauma and died three days later. According to prosecuting attorney R. Todd Garbett, Kautz’s hearing was moved to Soda Springs because of the incident’s “terrible impact on the community.” Kautz, who was in a relationship with Shelly Zapoloski, mother of the victim, referred to Andy as a step-son and emphasized in court documents the October incident was an accident. According to Franklin County Police records, Kautz had been charged with two previous DUI’s in 2007. He has 280 days credit towards his jail sentence as he has been incarcerated in Franklin County since his arrest on October 26th.
