Logan Council Spice ordinance could be overruled by state

While the Logan Municipal Council brought up a possible ordinance banning Spice, the Council also recognized that the state may create legislation that could override Logan’s legislation. The Logan City ordinance, if adopted, would prohibit the possession and use of Spice, an herbal and chemical product. Spice mimics the effects of marijuana. Logan City Attorney Kymber Housley said it is likely that the state will pass some form of legislation in January regarding the synthetic marijuana. Councilmember Herm Olsen said the state’s legislation could potentially preempt any local legislation or alter what Logan decides to adopt. The council decided to amend wording in the proposed ordinance in a way that wouldn’t automatically surrender Logan to resemble the state’s decision.
