Judge rules that Brigham City spice ordinance is invalid

A Box Elder County Justice Court Judge has ruled that Brigham City’s spice ordinance is invalid. Judge Kevin Christensen has dismissed criminal charges against the owner and an employee of Smoker’s Delite.According to the Box Elder News Journal, Brigham City Attorney Kirk Morgan says the ruling has no bearing on the city’s denial of Smoker’s Delite’s business license which was evoked when the criminal charges were filed. The city has 30 days to appeal the ruling. Morgan claims the business is closed so the entire question may be moot at his time now that the state has a law on the books making spice illegal. According to the Box Elder News Journal, Spice causes an effect similar to that of smoking marijuana.
