Logan man accused of Christmas Eve burglary waives preliminary hearing

LOGAN — A 32-year-old Logan man suspected of several burglaries in December and facing 35 charges has waived his right to a preliminary hearing.

James D. Merritt appeared in 1st District Court Wednesday afternoon. His public defender, Shannon Demler told the court, prosecutors had offered them a plea agreement and they are working on a possible resolution.

Merritt was arrested after he allegedly broke into a garage early on the morning of Christmas Eve and got into a fight with the homeowner. He faces charges including burglary and theft, both second and third-degree felonies along with other misdemeanors. He is suspected in a string of vehicle and home burglaries from September 1 through December 24. He is being held in the Cache County Jail without bail.

During Wednesday’s court appearance, Demler said Merritt may have some mental health issues they are exploring. He didn’t provide details about prosecutor’s plea offer but asked the court for time to consider it.

Judge Brian Cannell ordered Merritt to appear again February 2.
