Bear Lake’s eminent domain situation on hold

One of the six roads at the center of the lengthy Garden City legal battle.

GARDEN CITY – The eminent domain situation at the Shore Lodge Estates development is on hold, at least until next month while an offer is being considered. Garden City Mayor John Spuhler said the city met with the Shore Lodge Estate’s HOA representative to work something out.

“They were gracious enough to meet with us and come up with it,” he said. “Hopefully solve it to some degree.”

Spuhler had been planning on using eminent domain to acquire two lanes that connect Garden City with a public beach.

The lanes are two of six that have been the center of a legal battle since 2013. Residents of Shore Lodge Estates claimed the roads have always been private driveways, but others claimed they were public roads. After the matter went to court, First District Court Judge Thomas Willmore’s ruling declared the lanes private.
