Nibley man accused of sexting teenage girl now suspected of filming and distributing sex tapes

LOGAN — A 32-year-old Nibley man, who is already suspected of sexting a teenage girl, was arrested again for allegedly filming himself having sex with people, and distributing the videos on the internet. Nicholas L. Smith was booked into the Cache County Jail Thursday afternoon on suspicion of voyeurism and distribution of pornography.

Cache County Sheriff’s Chief Deputy Matt Billodeau said detectives believe Smith recorded himself having sex with people multiple times. The victims claim they consented to have sex but did not know they were being filmed. The videos appear to have been recorded in Nibley and also Logan Canyon.

Smith was originally arrested in December after a family member called deputies. They reported finding “disturbing text messages” on his phone. Detectives later found pornographic videos of him engaged in various sex acts. The movies were allegedly sent to several women, in exchange for pictures and videos of themselves.

One of the people Smith sexted with was an underage girl, who lives out of the country. They reportedly had a relationship for more than five-years that started when the girl was 12-years-old.

State attorneys have already charged Smith with enticing a minor over the internet and sexual exploitation of a minor, both second-degree felonies, dealing in materials harmful to a minor and soliciting or distributing child pornography, both third-degree felonies.

Court records show Smith was released on bail January 8, after posting a $20,000 bond. He was scheduled to appear again in court February 20.

Detectives believe some of the videos may have involved minors. They are trying to identify the victims.

Smith is expected to be arraigned again in 1st District on the new allegations next week. Additional charges are pending the completion of the investigation.

Billodeau said Smith’s case should be wake-up call to parents, to make sure they know who their children are communicating with online.
