LOGAN — A 33-year-old Logan man has been arrested and charged with breaking into a prior residence and assaulting the woman who lives there. Erasmo Avila was booked Saturday into the Cache County Jail.
Avila appeared in 1st District Court Tuesday morning. He has been charged with burglary, a second-degree felony; and misdemeanor assault.
Cache County Deputy Attorney Barbara Lachmar told the court that Avila is alleged to have broken into a west Logan apartment, where he had previously lived. He also assaulted his estranged wife, when she confronted him.
Lachmar said Avila claimed he is allowed there because his name is on the rental contract, even though the woman has severed all ties to the defendant.
Judge Brian Cannell agreed with Lachmar and told Avila, he is not allowed at the apartment or to have any contact with the alleged victim. He also set bail at $10,000.
Avila was ordered to appear again in court Tuesday. He could face up to 15-years in prison if convicted.
