Judge issues warrant for rape suspect after failing to appear in court

LOGAN — A judge has issued a warrant for a 24-year-old rape suspect and threatened to do the same for his attorney, after both men failed to appear before him in court.

Tyler S. Call is charged with raping a Utah State student in September 2017. His case was scheduled for a three day jury trial in October.

Call and defense attorney, Darwin Overson, were both scheduled to appear Tuesday morning in 1st District Court for a final pre-trial conference. Neither were present, after allegedly being notified of the hearing by mail by court staff.

Judge Brian Cannell expressed frustration with both men’s absences, especially after state prosecutor, Dane Murray, said Call and Overson have had no contact with his office as well. Murray said it has been frustrating, trying to contact both men ahead of of the trial.

Judge Cannell explained that he had no other choice but to cancel the upcoming trial and order that Call be arrested and held on a no-bail status. He also said he could issue a similar warrant for Overson for contempt of court, but said he would wait and try to determine the reason for the absences.

Police claim that Call went with the alleged victim to her room late on the night of Sept. 8, 2017. While there, they started off talking to one another from opposite ends of the room and then ended up snuggling on her bed.

According to a probable cause statement, he asked her for sex multiple times and she repeatedly told him “no.” However, he reportedly ignored her and raped her.

The alleged assault was reported to USU school officials on Sept. 10, one day after the incident happened.

Call was interviewed by officers on April 24, 2018, at the USU Police Department, before being arrested. He was later released from jail after posting $20,000 bail.

USU officials said Call was not attending USU at the time of the alleged crime and was never enrolled as a student.

Records show, Call is originally from Willard but was living in Logan at the time the allegations occurred. He could face up to life in prison if convicted.

    Really? That’s funny because he’s asked me out and I told him no and him and I are good friends. He’s been nothing but sweet and respectful to me so if you don’t really know him maybe you should keep your mouth shut instead of trying to fit in to the “hot gossip”

      But the evidence suggest otherwise, people do behave differently with different folks. Maybe he was nice to you but to that girl he caused her a lot of pain.

      I know these comments were awhile ago, but as the trial is still continuing my comment is very relevant. I Know the facts of this case. You’re very hypocritical to tell someone to stay out of a PUBLIC court case for simply not knowing this rapist personally. You don’t know the victim, so that means you shouldn’t stick your nose where it doesn’t belong either. These are facts you don’t want to accept for whatever reason, but it doesn’t make them any less true. I’m also guessing you don’t know that he’s admitted to this crime not once, but TWICE. Just because he was kind to you, doesn’t mean he couldn’t hurt someone else.

      I know these comments were awhile ago, but as the trail is continuing my comment is very relevant. You don’t get to tell people to stay out of a PUBLIC court case because they don’t personally know this rapist. Very hypocritical, because I’m positive you don’t know the Victim and here you are insinuating she’s not telling the truth. I’m guessing you’re not aware of his confessions? Yes, I said CONFESSIONS. Not once, but TWICE. This isn’t “hot gossip” and to minimize the pain of a rape victim is disgusting.

    Why is no one asking why it took 7 months to bring him in for questioning after the alleged rape was reported? He should have been brought in immediately. What is or was going on that it took the police so long to bring him in?

    In regards to this story, he was picked up then released later. There was a change in date but it didn’t get communicated to either him or his attorney.

    Yet another update…the final pretrial hearing is no longer on the court calendar. Rescheduled or charges dropped? Perhaps Mr. Feelwright can do his job and find out what happened.

    Called the court myself. No idea why the June 15th final pretrial hearing was moved but it was…to September 14th.
