Logan man to serve 1 year in jail for downloading child pornography

LOGAN — A 43-year-old Logan man has been sentenced to jail for downloading hundreds of videos and pictures of children being sexually abused. Daniel G. Archibald told the court he needed help and wanted to live a normal life someday.

Archibald was sentenced in 1st District Court Monday morning. He previously pleaded guilty to five counts of sexual exploitation of a minor, a second-degree felony; and one misdemeanor of distribution of an intimate image.

In June, Logan City police officers received a tip from agents with the Internet Crimes against Children Task Force (ICAC) at the State Attorney General’s Office. Archibald had been tracked downloading more than one hundred pictures and videos of child pornography through a social media account.

When police served a warrant to Archibald’s residence they located the material on multiple electronic devices. Those items were seized and sent to the Utah State Crime Lab for forensic analysis.

Officers later located nude photos that Archibald had posted of an acquaintance without her knowledge. The material had been shared on a social media account.

During Monday’s sentencing, defense attorney David Mack explained that Archibald suffered from learning disabilities that made it hard to process information. He said that was no excuse for his client’s conduct, but explained that it likely led him to having a low self-esteem and gravitate toward addictive behavior.

Archibald told the court he regretted what he had done and felt remorse for his actions. He said he had gotten so addicted to pornography that he lost control.

Judge Thomas Willmore yelled at Archibald, as he slammed his hand on his desk. He said, what the defendant had done by viewing and sharing the material of children being raped, showed that he needed punishment, not rehabilitation. He noted that investigators described some of the pornography as some of the worst content they had ever seen.

A pre-sentence report recommended that Archibald serve 210 days in jail. It was provided to the court from probation agents.

Judge Willmore refused to follow the recommendation and ordered Archibald to serve one-year in jail. He also placed him on probation for 48 months, ordered him to complete community service and undergo counseling.

“You are a convicted sex-offender,” Willmore told Archibald. “If you violate any of these rules, you will be sent to prison. That is where you should be for looking at photos for 8- year-old girls.
