LOGAN — A 33-year-old Logan man has confessed to breaking into his prior residence and attacking a man. Erasmo Avila accepted a plea deal that could place him in jail for up to a year.
Avila appeared in 1st District Court Tuesday morning. He pleaded guilty to an amended charge of criminal trespass, a class A misdemeanor; and assault, a class B misdemeanor.
In July, Avila broke into a west Logan apartment, where he had previously lived. He found his estranged wife and a man, sitting on a couch. He became angry and assaulted the man.
In January, Avila assaulted his estranged wife while he was on pre-trial release from jail. He attacked her and pulled out some of her hair. He had previously been ordered to have no contact with her.
Avila was allowed to be released again, under the condition that he wear an ankle monitor. He is also prohibited from having any communication with the victims.
Judge Brian Cannell accepted the conditions of the plea deal. He ordered Avila to appear again in court April 13.
