LOGAN – A citywide mandate making the wearing of face coverings mandatory for Logan City residents and visitors will not take effect until Saturday, but Mayor Holly Daines has already scheduled a vote by the Logan City Council to extend the emergency measure until Dec. 31.
That vote has been set for Aug. 18.
The mayor has informed city council members that City Attorney Kimber Housley has advised that Logan is not required to solicit public comment on the extension of the mask mandate.
In an e-mail message dated Friday, July 31, Daines recommended that no public hearing be scheduled on the mask mandate, but left that decision up to the members of the city council.
While acknowledging that “there are strong feelings on both sides of the mask mandate,” Daines’ message stressed that 80% of e-mails she has received from members of the public are supportive of the mask mandate.
Logan City Councilman Jess Bradfield has indicated that he favors a public hearing on the requested extension, since the mayor provided no opportunity for public discussion of her plan prior to requesting authorization from Gov. Gary Herbert to impose the mask mandate.
“I will fight like hell to represent all Logan residents, not just those on the side (of the mask mandate) that I happen to agree with,” Bradfield said.
“If the mayor or council seek to limit residents’ ability to publicly comment, I will immediately move to strike down the executive order,” he added. “We must allow all sides to have a voice.”
Bradfield explained that he now has reservations about the mask mandate because he feels that Daines misrepresented her intentions when she initially discussed the issue with council members on July 21.
At that time, Daines said that the mask mandate would not be enforced punitively. Under the executive order that Daines signed Thursday, however, individuals can be cited either “administratively or criminally … for repeated or egregious violations.”
That executive order applies to any individual over age five who is medically or psychologically able to tolerate a face covering.
The city ordinance stipulates that a face covering that completely covers the nose and mouth must be worn in “public areas where consistent social distancing of at least six feet is not possible, reasonable or prudent.”
With that order, Logan has joined a handful of other local entities in Utah that have made the wearing of face coverings in public mandatory. Those entities are Salt Lake City and three Utah counties: Grand, Salt Lake and Summit.

Council members have a responsibility to listen to and represent the people of Logan. I haven’t ran for office and do not hold a public office. If I did, then my information would be on the Logan City website and anyone could access that information. If they don’t understand that, then they shouldn’t run for office. Please read both the Utah and US Constitution and cite the article that you believe supports your theory of a mask mandate being unconstitutional. You not liking it in no way makes it unconstitutional. However, it may make you delusional for thinking that you’d be that important.

Let’s start with the First Amendment of freedom of speech. An individual’s clothing is considered to be constitutionally protected speech/expression; since a mask is worn on one’s body (the face) it is considered “clothing.” “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof….” How about the Fourth Amendment where each individual has the “right to be secure in their persons, houses, papers, and effects…” The Nineth Amendment which delegates powers given BY the people TO the government. We the people have inalienable rights, the government does not. The government has powers that have been delegated to them and are thoroughly outlined in the text of our Constitution. The threat of public health (whether real or imagined), safety, security, etc., does NOT suspend nor does it supercede our individual Constitutionally-protected rights irrespective of the circumstances, the Covid included.

Even though I am vehemently against a mask mandate (the science is very mixed on the effectiveness of cloth masks), we really need people to stop saying this is unconstitutional, actually, it is very constitutional. Because the constitution gives states control over large amounts of decision making (especially in the area of health) this falls directly within the control of the state. However, with that said, how the heck are we going to police this, and with this having a possibility of becoming a class B misdemeanor!?! If you are not aware that carries up to a $1000 fine! This is very sad that our mayor decided to implement this without a public vote.
The science overwhelmingly shows that wear masks, even homemade ones has benefits. Countries and states that have implemented mask wearing are overall fairing better than those that aren’t so the anecdotal evidence also supports mask wearing. Whether of not you choose to believe it may be a different story.

As for any who want to say that it isn’t about freedoms or rights it is everything to do with that. What it isn’t about is the wearing of masks. No one is telling you not to wear the mask if you wish. What we are against is elected officials stepping around the people to make executive mandates that are not voted on by the people. This is against constitutional rights. It’s far more dangerous then this little virus ever dreamed of being. Not every issue is political. This is a health and safety issue for the entire community. The old saying “your rights end where mine begin” applies here. When you want to endanger others, then you may have see restriction. Much like the many OTHER safety regulations we already have, wearing a face covering during the pandemic spread of a new virus is to protect the community as a whole, not each of you individually.

I frankly disagree with wearing masks until the end of December. I prefer the wait and see approach and access what the covid impact is in early October.

The mayor may say 80% have voted for masks but many many people may have simply not voted, therefore not represented. Taking a stand to make masks mandatory that far in the future seems more like ” government control”. I vote for our city council who represent all people in Cache county to make an informed decision in late September or October.

I have always been grateful to have the opportunity to express my opinon especially when it comes to my community. I appreciate those we vote into office and their willingness to give of their time to serve our community with our imput. I am appreciate knowing those who serve are always wanting to look out for what is best interest for our community. I know it can be a challenge to want to overlook what we say, yet honestly you’re serving the public and I would think you would want to know how we feel. I personally am frustrated with the question of wearing a mask or not. For me, I feel I am capable of making this decision and having to wear a mask to support local stores I will. As, for my government telling me I have to I feel is taking away my freedom to chose. If you all would do the right thing and wear a mask without being told to, no one would have to tell you to. The whole reason we have laws is because a significant portion of society couldnt be bothered to do the right thing without the penalty of consequences. I am upset that the mayor and city council has gone this far on a topic that we see just as much opposing science as we can see science for benefit. When science can’t agree, then there is probably a sham going on. I would like to know how the mask mandate is enforceable under law…..please, I am open to anyone to explain the legalities here. How can I be forced or penalized to wear an object in public. I can see and perhaps will participate in multiple lawsuits against the city and the individuals involved. This feels wrong, it is overstepping, and should be stoped.

Only way to combat this is to write the council members and mayor. Those in favor of this bill have begun a email campaign and we can not let there voices overshadow the silent majority. If you dont want to be forced to wear a mask, a fear reminder for our kids, have fines imposed on already struggling citizens, and have citizens snitching on other citizens, all in the name of safety then Please write or call them. People of cache valley are smart, decent, and common sense enough to do what they need to do to protect themselves and loved ones. Not to be forced by a elite mayor.

What is the legal basis for an executive order? What duly passed law backs up this order? I really want to know, because I don’t believe the executive, whether in a city or state government can unilaterally create law. If there isn’t a law backing this then there can be no enforcement.

We all know that the reason Mayor Daines issued this mandate is because people weren’t doing the right thing when given the choice. I’ve watched people in Logan celebrate their 65 year anniversary on opposite sides of a window. I’ve seen the families from JBS struggling to put food on the table and I’ve seen the toll the wearing PPE takes on our healthcare workers. That alone should inspire us all to do our part, but sadly it hasn’t.
There are two was to squash this pandemic – either everyone gets it, or we stop the spread and wait for a vaccine. The first will destroy our economy and way of life since herd immunity requires at lease 50-60% of the population to become infected and live (only 160 million more infections to go!) The second requires everyone, doing everything the can – including wearing a mask. This limp along state that we are in is idiotic and could last for years. The NASDAQ is doing create but us middle class folk are struggling.
Today in the 100 degree heat me and my five year old wore our masks while choring and playing outside. I figure if he can wear it in today’s heat, school will be a breeze. Had our nation or our state acted sooner maybe he wouldn’t be required to wear a mask in kindergarten.
School is starting soon, USU will be back soon then it’s flu and bad are season. Lets do all we can now to improve our position come winter.
I am still angry about this unnecessary mask mandate as it is. She said that people would only be given a lecture, but now according to the news police can give you a citation. They don’t have enough to do that they can hang out all day writing mask citations when I can’t get them to respond to a complaint. Their priorities are all messed up. I think the citizens of Logan need to keep her phone lines jammed and let her know what we think about this mandate much less imposing another one in 30 days. She is power hunger. I didn’t live her when she was voted in, but you can believe that I when she come up for re-election I’m going to make sure I help to vote her out.

It’s just a mask, it’s not a big deal, and it’s not going to hurt you. You wear a shirt and shoes when you go into a place of business because you’re asked to, and I don’t hear anyone babbling on about that going against their “constitutional rights.” People who are getting their undies in a twist over this need to stop being babies about it, and learn how to just be respectful.
